Public Offer Agreement for the Provision of Tourist Services<\/strong><\/p>

This document is an official offer from LLP AirNexx (hereinafter referred to as the “Service Provider”), represented by General Director Kuram Saeed, acting under the Charter, to individuals and legal entities to conclude an agreement for the provision of tourist services under the terms outlined below. It is published on the website\u00a0<\/a>https:\/\/www.tournexx.kz<\/u><\/a>.<\/p>

In accordance with paragraph 2, Article 437 of the Civil Code of the Republic of Kazakhstan, this document is a public offer.<\/p>

Definitions<\/strong><\/p>

In this public offer, the following terms are used with the meanings defined below:
\u00a0Service Provider<\/strong>\u00a0\u2013 Limited Liability Company “AirNexx,” which has published this offer on the website\u00a0<\/a>https:\/\/www.tournexx.kz<\/u><\/a>.
\u00a0Offer<\/strong>\u00a0\u2013 This document titled “Public Offer Agreement for the Provision of Tourist Services,” published online at\u00a0<\/a>https:\/\/www.tournexx.kz<\/u><\/a>.
\u00a0Offer Agreement<\/strong>\u00a0\u2013 An agreement between the Service Provider and the Client for the provision of tourist services, concluded through acceptance of the offer.
\u00a0Acceptance of the Offer<\/strong>\u00a0\u2013 Complete and unconditional acceptance of the offer\u2019s terms by the Client through actions expressing an intent to use the Service Provider’s website to book services.
\u00a0Website<\/strong>\u00a0\u2013 A publicly accessible website at\u00a0<\/a>https:\/\/www.tournexx.kz<\/u><\/a>, where information about the services provided by the Service Provider is displayed.
\u00a0Client<\/strong>\u00a0\u2013 A user, individual, or legal entity who has accepted the offer and, thus, becomes the recipient of services under the Offer Agreement.
\u00a0Order\/Application<\/strong>\u00a0\u2013 A properly completed request by the Client for services selected on the website.
\u00a0User<\/strong>\u00a0\u2013 A legally capable individual aged 18 or older who has the lawful right to enter into agreements with the Service Provider.
\u00a0Payment System<\/strong>\u00a0\u2013 A company providing electronic payment services on the website for the Service Provider.<\/p>

Subject of the Agreement<\/strong><\/p>

The subject of this agreement is the provision of tourist and other related services by the Service Provider to the Client under the terms of this agreement. Tourist services refer to a package of services for one-day or multi-day tours within Kazakhstan.
\u00a0The list and content of tourist services are detailed on the Service Provider’s website at\u00a0<\/a>https:\/\/www.tournexx.kz<\/u><\/a>.
\u00a0The Client fully accepts the terms of this Agreement. Complete and unconditional acceptance of the Agreement’s terms is demonstrated by the Client\u2019s registration on the Service Provider’s website and payment for tourist services.
\u00a0Unless otherwise provided by this Agreement or required by law, the contractual rights and obligations of the Client extend to tourists for whom the Agreement is concluded.<\/p>

Rights and Obligations of the Parties<\/strong><\/p>

Obligations of the Service Provider:<\/strong><\/p>

  1. Provide the tourist services in full, as per the tour program selected by the Client. The tour price is determined by the Service Provider and displayed on the website.<\/li>
  2. Ensure the quality of services in accordance with standards established by the legislation of the Republic of Kazakhstan.<\/li>
  3. Inform the Client about the terms and content of the services provided.<\/li>
  4. Notify the Client about the rights and obligations of third parties involved in the service delivery.<\/li>
  5. Notify the Client in a timely manner about any changes in service prices or terms due to reasons beyond the Service Provider’s control.<\/li>
  6. Communicate any changes to the tour\u2019s terms resulting from significant changes in circumstances or force majeure events.<\/li><\/ol>
